Proland Ltd – Cancellation & Rental Policy
This policy outlines the terms and conditions for use of our apartments, reservations,
cancellations, refunds and security deposits when booking with Proland Ltd.
1. Use of Property
The Tenant agrees to abide by and adhere to the Terms and Conditions named in this Apartment
Rental Agreement.

The number of occupants on the property shall not exceed the number stated in the rental
application form that was submitted and accepted at the time of booking. Property insurance
limits occupancy for several reasons; therefore, it is strictly prohibited to exceed the
maximum number of guests allowed at the property.

The rental property, and all furniture, appliances, equipment, fixtures and effects in or
about the premises, must be maintained in the same state and condition as found at the
beginning of the rental.

Any part or portion of the property, or any part or portion of furniture, appliances,
equipment, fixtures or effects in or about the premises that is damaged or destroyed will be
deducted from the Security Deposit and/or charged to the Tenant.

The rental property must be promptly vacated at the end of the rental period, as per the
designated check-out time (10:00 a.m.), unless otherwise arranged and approved by Proland Ltd
prior to arrival. Late departure may result in a deduction from the Security Deposit.

Any damage(s) or concern(s) discovered upon arrival to the rental property shall be documented
and reported immediately to Proland Ltd. Tenants are strongly encouraged to conduct their own
inspection of the rental upon arrival.

Any problems, deficiencies or complaints with the rental property shall be communicated
immediately, with photos provided where possible. Proland Ltd cannot carry out a proper inquiry
without reasonable grounds or reasonable time to investigate before the end of the rental.

All apartment rental rules must be followed. If the Tenant or a member of the Tenant’s group
violates these rules:

Proland Ltd may withhold a portion or all of the Security Deposit if a violation results
in a complaint from a neighbour, illegal activity requiring police involvement, or if the
rental property is left in an unacceptable state (including but not limited to garbage not
disposed of properly, alcohol containers/cigarette butts uncollected, burns and stains).

Guests may be asked to vacate the premises if behaviour is problematic, including but not
limited to: environmental or wildlife endangerment; threatening or abusive behaviour
resulting in bodily harm; excessive noise; property damage; or exceeding the maximum
number of guests.

Proland Ltd staff, approved service providers and/or the Owner(s) shall be allowed reasonable
access to the rental in the event of a problem or major disruption where repair or attention is
required.

All applicable laws and bylaws must be followed at all times. It is the Tenant’s responsibility
to be informed, especially with respect to noise, fire regulations, licensing and operation.
Tenants are not to leave garbage outside as this can attract wildlife and compromise safety.
Tenants must properly dispose of all garbage and recycling either:
- In the designated collection location on the premises; or
- By taking it with them at departure.
Tenants are prohibited from smoking inside the rental property (tobacco or otherwise) and must
ensure all cigarette butts are properly extinguished and disposed of in the garbage safely. Failure
to comply may result in a deduction or loss of the Security Deposit and/or additional charges.
The use of tents, travel trailers and mobile homes is prohibited on the rental property.
Tenants must park only in the designated spaces provided. Parking on lawns, neighbouring driveways
or septic beds is strictly prohibited.
2. Reservations

Proland Ltd will process and handle each application as quickly as possible; however,
acceptance of any particular application cannot be guaranteed.

Proland Ltd requires a non-refundable booking fee (paid by debit or credit card) at the time
of reservation to secure the rental. Once confirmed, the Tenant becomes liable for the
remaining balance for the full period of the rental.

The Tenant shall pay the remaining balance for the rental booking as outlined:
- 50% of the rental rate (before taxes and fees) is due immediately.
- The remainder of the balance is due no later than the agreed-upon date in the Rental Agreement.
- If the beginning of the rental is less than one month from the booking date, all payments are due in full immediately.

Proland Ltd will hold all bookings as reserved until the final payment due date. If, 48 hours
after this date, payment has not been received, the booking may be cancelled by Proland Ltd.
Payments can be made using one of the following methods:
- Direct payment to Proland Ltd online using debit or credit card.
A refundable Security Deposit is required. The Security Deposit is held in trust until an
inspection of the rental property can be completed after check-out to confirm that there is
no loss or damage. Proland Ltd will release the Security Deposit via online transfer, unless
otherwise arranged and approved.
3. Cancellation & Refund Policy

Proland Ltd reserves the right to consider the rental cancelled in the following circumstances:
- If the Tenant provides written notification of cancellation; or
- If the Tenant fails to pay the balance of the rental by the specified due date.
In the event that a booking is cancelled, Proland Ltd may, without being obliged to do so,
attempt to rebook the property for the same period.

If the booking is cancelled more than one month before the booking date, the Tenant is refunded
all monies paid, less the 15% non-refundable booking fee.

If the booking is cancelled less than one month before the booking date, the Tenant will be refunded
all monies, less the 15% non-refundable booking fee only if the apartment is rebooked for
the same period. If the apartment is not rebooked, there will be no refund.

If the rental property has been damaged by unforeseen circumstances (such as fire, flood or other
acts of nature) and is deemed “not rentable”, Proland Ltd will make every effort to find another
suitable alternative rental for the same period. If no alternative can be found, the agreement
becomes null and void and all payments will be refunded to the Tenant.

If the property has been subject to a power-of-sale action or similar situation, Proland Ltd will
again attempt to find a suitable alternative rental. If no alternative can be found, the agreement
becomes null and void and all payments will be refunded to the Tenant.

Inconveniences during the rental (for example, appliance failure, technical difficulties, or
electricity/hydro disruptions or outages) do not entitle the Tenant to a refund or discount. Proland
Ltd will make reasonable efforts to assist and resolve such problems.

If there is a violation of the Terms and Conditions by any or all Tenants, Proland Ltd reserves the
right to refuse entry to the rental premises or to require early departure. Proland Ltd has a zero-tolerance
policy for infringement of the Apartment Rental Agreement, including but not limited to aggressive,
unruly or unsafe behaviour, and no refund will be provided in such cases.
4. Security Deposit

Proland Ltd is entitled to collect from the Tenant a returnable Security Deposit as security for
performance of the Tenant’s obligations under the rental. The Security Deposit may be fully forfeited
if the Tenant violates the terms and conditions of the Apartment Rental Agreement.

Accidental damage insurance (where applicable) covers small unintentional damages that occur during
the rental period. The Tenant may be asked about the circumstances of any damage.

Proland Ltd reserves the right to be the final arbiter in any malicious damage claims made by the
Owner(s), and to determine the amount of any full or partial payment to the Owner(s) from the Security Deposit.

The Tenant is solely responsible for any and all malicious damage caused during the rental period.

The Tenant shall advise Proland Ltd immediately of any problems, deficiencies or concerns with the
rental property, and is encouraged to document such issues to avoid penalty. Tenants must also disclose
any new damage or concerns that arise during the rental period.

The Tenant shall not exceed the maximum occupancy of the rental property, nor exceed the number
stated in the approved rental application form. Failure to comply will result in forfeiture of the
Security Deposit.
5. Proland Ltd Responsibilities

Proland Ltd acts as the Owner of the apartments and assumes responsibility for the state of the
property. Information provided by Proland Ltd online or in print is true and accurate at the time of
publication; however, changes may occur and Proland Ltd will not be liable for such changes or any
resulting inconvenience.

Proland Ltd accepts no liability for any loss, damage, expense, accident, injury or inconvenience,
whether to persons or property, arising out of or in connection with the rental.

Proland Ltd shall not be responsible for death, personal injury or loss of any kind, whatever the
cause, incurred by any or all of the Tenants (or their pets) while on the rental property during
the rental period.

Proland Ltd shall not be responsible for interruptions that may impact the Tenant’s rental experience,
including but not limited to: construction noise, inclement weather, electricity/hydro outages, theft,
allergies, noise violations or traffic during the rental period.
6. Tenant Responsibilities

The Tenant agrees to read, understand and adhere to the Terms and Conditions outlined in this Apartment
Rental Agreement provided by Proland Ltd.

The Tenant accepts all potential risks associated with the apartment rental, including but not limited
to: slips, trips and falls; indoor and outdoor activities; native insects and wildlife; recreational
equipment operation; or any other risks not specifically stated.

The Tenant agrees to take reasonable precautionary measures to reduce risks and prevent accident, injury
or property damage.

The Tenant agrees to abide by any reasonable household rules posted at the apartment.

The Tenant agrees to inform all members of their party about these Terms and Conditions and to ensure
they also comply with them.
7. Privacy
Protecting personal information is a priority for Proland Ltd. Personal information is collected and used
in accordance with our Privacy Policy and is kept confidential, not made available to anyone outside of
the company except as required for the purposes for which it was collected or as permitted by law.
